Terms and Conditions
The use of Internet sites (hereinafter referred to as "Caverleyshoes.com / .au websites") offered by Caverley Shoes Pty Ltd (ABN 18632540133) or DC Collective LLC (hereinafter referred to as "Caverley") is permitted exclusively on the basis of these conditions. These general terms and conditions of use may be supplemented, modified or replaced in individual cases by other conditions. Use of Caverely websites indicates acceptance of the validity of the current version of these terms and conditions of use.
Content of the online offer
The individual pages of the online offer have been carefully edited and checked. However, Caverley accepts no liability for the currency, accuracy, completeness or quality of the information provided. Liability claims against Caverley or it’s affiliates relating to damages of a material or immaterial nature caused by the use or non-use of the offered information or by the use of erroneous and incomplete information are excluded as a matter of principle in so far as there is no demonstrable intentional or grossly negligent fault on the part of Caverley. Caverley expressly reserves the right to amend, supplement and delete parts of sites or the entire offer without separate notice or to cease publication at times or entirely.
Liability for external links
Caverley shall only be liable for direct or indirect links to external Internet sites that are outside Cavelrey’s area of responsibility if Caverley has knowledge of the contents and it is technically possible and reasonable for Caverley to prevent use in the event that the contents are illegal. Caverley hereby expressly declares that at the time when the links were established there were no illegal contents apparent on the linked sites. Caverley has no influence of any kind on the current and future design, contents or authorship of the linked sites. Caverley therefore hereby distances itself expressly from all contents of all linked sites that have been changed since the link was established. This statement applies to all links and references that come within Caverley’s own Internet offer. Solely the provider of the site to which reference has been made, and not Caverley, shall be liable for illegal, erroneous or incomplete contents and in particular for damages arising from the use or non-use of this type of offered information.
Copyright and trademark law
Copyrights and trademark rights for information made available on Caverley websites are due to Caverley alone, in so far as there is no indication to the contrary. Text, pictures, graphics, sound, animations and videos, plus their arrangement on the Caverley websites, are subject to the protection of copyright and other protective laws. The contents of Caverley websites may not be reproduced, distributed, changed or made available to third parties. Unless stated otherwise, all trademarks on Caverley websites are protected under trademark law in favor of Caverley. This applies in particular to brands, model designations and logos. Caverley has striven to observe valid copyrights for all information made available on Caverley websites. Should an infringement of copyright occur nonetheless, Caverley will remove the relevant information once informed or identify it with the relevant copyright. All brands and trademarks named within Caverley websites and, where applicable, protected by a third party are subject without restriction to the provisions of the relevant applicable trademark law and the possessive rights of the respective registered owner.
Respecting the personal rights of our customers and partners is a matter of fundamental principle for us. This includes how we handle personal data from your Internet visit. We know that you as an Internet user want your privacy sphere to be protected. We therefore act in accordance with the applicable legal provisions for the protection of personal data and for data security. Below, you can find out what data we collect, process and use and for what purposes, what rights of information you have and lots more.
Area of application
This data protection statement applies to the use of the website (hereinafter referred to as the ‘Caverley website’) provided by Caverley Shoes Pty Ltd or DC Collective LLC (hereinafter referred to as "Caverley"). This data protection statement does not apply to the websites of other service providers to which the Caverley website merely refers by means of a link.
Personal data are individual details about personal or material circumstances of a specific or determinable natural person. The fundamental personal datum is your name. Your address, bank account, identity card or telephone number, your email or IP address, and information about which writing system you prefer, for example, are also deemed to be personal data if they are connected with your name or can be assigned to your name by us with the means at our disposal. Such data with which it is not possible to determine your actual identity or with which to do so would at least require considerable effort are not, however, deemed to be personal. These include for example the above-mentioned information if we receive it in anonymous form or under a pseudonym and cannot therefore assign it to a natural person.
When using the Caverley website you will remain anonymous unless you voluntarily and at your own discretion provide us with personal data, such as by completing our contact form.
Automatic gathering, processing and use of personal data
On each of your visits to the Caverley website, we will automatically collect information about which IP address is assigned to your computer, which browser and which operating system you use and which areas of the Caverley website you have viewed. These data are stored in log files on the Web server. To protect against misuse of our computer systems, it is necessary to store the IP address of each visitor for a temporary period. If in addition we use the log files to assess general user behaviour for the purposes of advertising, market research or to design our website to meet the needs of users, the IP addresses and the personal data that we have received or stored from the respective user will be rendered anonymous in advance. Otherwise, the IP addresses will be deleted from the log files. As a result, you will in any event remain anonymous in connection with the automatic collection and temporary storage of your IP address. Assessment of the user behaviour, incidentally, means a statistical assessment of the click stream – i.e. which website the user comes from, how long he/she stays on the Caverley website, which areas of the Caverley website are visited and in what sequence, and for what destination the visitor leaves them. This is not to be confused with the collection of use profiles in which the surfing behaviour of a specific person is registered and stored.
Other collection, processing or use of personal data
We will only collect, process or use your personal data if you provide such to us voluntarily at your own discretion and this is legally permitted or you have given your consent.
Purpose of collecting, processing or using personal data
We will use the personal data provided by you exclusively for the purposes stated in this data protection statement or expressly agreed with you.
Use of personal data for the purpose of advertising or market research
To nurture the customer relationship with you, we will be interested on occasion in using your personal data for advertising, market research and other purposes. We will, of course, inform you of this in advance and request your express consent.
Passing on, sale or transfer of personal data to third parties
Your personal data will not be passed on, sold or transferred otherwise to third parties unless this is required for the stated or agreed purposes and is permitted without express approval under data protection law or you have expressly given your consent.
Withdrawal of consent
Under the legal provisions you have the option at all times to withdraw your consent for the collection, processing and use of your personal data for the future. To do this, please get in touch with the contact mentioned below.
On the Caverley website we as a rule use session cookies, which place data for technical session control in the memory of your browser. These data are not personal and are deleted at the latest when your browser is closed. If exceptionally we wish to store personal data in a cookie, we will seek your express consent in advance.
Caverley will take technical and organizational security measures to protect your personal data from loss and misuse. Your data will be stored in a secure operating environment that is not accessible to the general public. In certain cases your personal data will be encrypted on transmission by the Transport Layer Security (TLS) (formerly: Secure Socket Layer Technology (SSL)). This means that communication between your computer and the Caverley servers will take place using a recognized encryption method that in the current version at the time is deemed to be secure (at present: TSL Version 1.0, 128 bit). If your browser supports TSL, the transmission of personal data will be protected by this function. In this case most browsers will indicate to you by means of a short dialogue field or by a graphics symbol whether the security protocol is supported. You can find further information under the help function of your browser. If you wish to get in touch with Caverley by email, please note that the confidentiality of the communicated information is not guaranteed. The content of unencrypted emails can – like postcards – be read by third parties. We therefore recommend you to send confidential information to us only by post.
Right to information
On request we will be pleased to inform you what personal data we store about you, if we do at all. To do this, please get in touch with the contact mentioned below.
Changes to this data protection statement
The fast technological development of the Internet and the changes to the law in the area of data protection make it necessary for us to adapt our data protection statement from time to time to the new requirements. Please therefore take notice of the latest version of the data protection statement. This data protection statement has the status of January 2010.
If you would like to make use of your rights to information or have any questions concerning this data protection statement or our data protection behavior on the Web, please contact: info@Caverleyshoes.com
